MENGADILI:

1. Menyatakan Terdakwa John Mar Plenos Tagolino tersebut di atas, terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana Selama berlayar Nahkoda tidak mematuhi ketentuan yang berkaitan dengan tata cara berlalu lintas sebagaimana dalam dakwaan Penuntut Umum ;
2. Menjatuhkan pidana kepada Terdakwa oleh karena itu dengan pidana penjara selama 3 (tiga) bulan ;
3. Menetapkan pidana tersebut tidak perlu dijalani oleh Terdakwa kecuali di kemudian hari ada perintah lain dalam suatu putusan hakim yang telah berkekuatan hukum tetap karena Terdakwa melakukan tindak pidana sebelum habis masa percobaan selama 6 (enam) bulan ;
4. Menjatuhkan pidana denda kepada Terdakwa sebesar Rp100.000.000,00 (seratus juta rupiah) dengan ketentuan apabila denda tidak dibayar maka diganti pidana kurungan selama 1 (satu) bulan ;
5. Menetapkan barang bukti berupa :
