1. Menyatakan terdakwa Nguyen An Hai telah terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana ?Nahkoda yang berlayar wajib mematuhi ketentuan yang berkaitan dengan tata cara berlalu lintas sesuai undang-undang pelayaran.
2. Menjatuhkan pidana terhadap terdakwa oleh karena itu dengan pidana penjara selama 15 (lima belas) hari dan denda sebesar Rp. 25.000.000 (dua puluh lima juta rupiah) dengan ketentuan apabila denda tersebut tidak dibayar, maka akan diganti dengan pidana kurungan selama 15 (lima belas) hari;
