Dimana PENGGUGAT dalam melakukanpekerjaanya merasa tidak pernah melakukan kesalahan apapun danPENGGUGAT tidak pernah menerima surat peringatan sebelum adanyaPemutusan Hubungan Kerja (PHK) sepihak oleh TERGUGAT (PT.BEYOND BORDERS INDONESIA), maka dari fakta hukum tersebut inimerupakan murni keinginan TERGUGAT selaku perusahaan yang inginmemutuskan hubungan kerja secara sepihak kepada PENGGUGAT.

Bahwa, terhadap angka 3 dalil gugatan Penggugat Konvensi dengan tegasTergugat Konvensi tolak karena disamping menyebutkan jumlah pekerjayang ada diperusahaan Tergugat Konvensi dengan jumlah yang salah, jugajelasjelas di perusahaan Tergugat Konvensi tidak ada tenaga kerja warganegara asing, yang ada warga negara asing tersebut adaiah sebagaiDirektur PT Beyond Borders Indonesia yang tercantum dalam akta pendirianperusahaan.
